Update To Great Lakes Restoration Initiative Action Plan 2015-2019

The Great Lakes Interagency Task Force has scheduled meetings for the public to provide input to a planned update of the Great Lakes Restoration Initiative Action Plan. The updated Action Plan would direct Great Lakes restoration for fiscal years 2015-2019. The public may comment directly to the federal agencies and to the Great Lakes Advisory Board (GLAB), a panel of experts established to provide recommendations to the federal agencies.

Comments may be given at any of the following scheduled meetings:

 •May 23 - Webinar
•May 28 - Buffalo, New York.

In February 2010, the Task Force released the GLRI Action Plan for FY2010-2014. The Action Plan identified goals, objectives, measurable ecological targets, and specific actions to help rehabilitate the Great Lakes. The Action Plan targets investments to reduce toxic contamination, rehabilitate fish and wildlife habitat, improve nearshore health, reduce nutrients and other land-based pollution, prevent invasive species, and promote accountability, education, and collaboration.

Summary of 2011 EPCRA 313 TRI Releases To Great Lakes

Releases of EPCRA Section 313 reportable chemicals into surface waters in the Great Lakes Basin increased by 12 % from 2010 to 2011, according to the U.S. Environmental Protection Agency’s annual Toxics Release Inventory report. Nationwide, releases due to surface water discharges decreased by 3 %.

Nitrates and pesticides from municipal wastewater treatment plants and agriculture account for most of the releases from surface water discharges to the Great Lakes Basin. Nitrates were also discharged by primary metals facilities, such as iron and steel mills and smelters, and food and beverage manufacturers.

For the summary, the Great Lakes Basin consists of Lakes Superior, Michigan, Huron, Erie and Ontario; a number of other smaller lakes and waterways; and the surrounding watershed. The watershed covers parts of Illinois, Indiana, Minnesota, Michigan, New York, Ohio, Pennsylvania and Wisconsin, and parts of Ontario in Canada. Despite increases from 2010 to 2011, overall Section 313 releases in the Great Lakes Basin have decreased about 40 % since 2003 and are currently at the second-lowest level in a decade. Surface water, air and land releases in the basin increased by 12, 1 and 4 % respectively, while underground injection decreased 5 % from 2010 to 2011.

Lake Erie No Discharge Zone Proposed By EPA

The U.S. Environmental Protection Agency (EPA) is accepting public comment until January 6, 2013 on the agency's tentatively determination that there are adequate facilities around Lake Erie for boats to pump out their sewage, allowing the establishment of a “no discharge zone” for 593 square miles of the lake, its tributaries and bays, and 84 miles of shoreline that comprise the New York State portion of the lake. The no discharge zone, which was proposed by the New York State Department of Environmental Conservation, means that boats would be banned from discharging sewage into the water. Boaters would instead dispose of their sewage at specially-designed pump-out stations.

This action is part of a joint EPA/New York State strategy to eliminate the discharge of sewage from boats into the state’s waterways. The proposed no discharge zone for the New York State portion of Lake Erie includes the waters of the lake from the Pennsylvania-New York State boundary, as well as the Upper Niagara River and numerous other tributaries, harbors and embayments of the Lake, including Barcelona Harbor, Dunkirk Harbor and the Buffalo Outer Harbor.

Minnesota Department of Health Grant To Reduce Mercury Exposure From Fish

The U.S. Environmental Protection Agency has awarded a $1.4 million Great Lakes Restoration Initiative (GLRI) grant to the Minnesota Department of Health (MDH) to reduce mercury exposure risk for women and children who live along Lake Superior’s north shore. Excessive blood mercury levels have been documented in infants in this area. The funding will be used to improve health screening and to develop more effective fish consumption advisories. Over the last three years, the GLRI has provided more than $320 million to clean up toxic contamination in Great Lakes Areas of Concern and to reduce the risks associated with toxic substances in the Great Lakes ecosystem.

The Grand Portage Chippewa Tribe and the Sawtooth Mountain Clinics in Grand Portage and Grand Marais, Minnesota will participate in the MDH project. Physicians affiliated with the clinics will survey consenting female patients of childbearing age about fish consumption and test blood mercury levels. Patients will also be counseled to promote safe fish consumption choices.

The work supported by the grant will build on an earlier EPA-funded study which was completed last year by MDH. In that study, 1,465 newborns in the Lake Superior Basin were tested for mercury in their blood. The study found that 8 % of the infants had mercury levels higher than those recommended as safe by EPA.

Great Lakes Restoration Initiative Grants Awarded In Michigan

The U.S. Environmental Protection Agency has announced Great Lakes Restoration Initiative grants for projects in Michigan to improve water quality and reduce excess nutrients that contribute to harmful algal blooms in Great Lakes watersheds, including Lake Erie, Lake Huron and Lake Michigan. The restoration projects in Michigan are:
  • $350,000 to the Michigan Department of Environmental Quality For Nutrient Reduction in the River Raisin and Lake Erie Basin: This project will reduce agricultural sources of nitrogen and phosphorus by 30 -50% through the installation of 133 water control structures on 4,000 – 5,000 acres of tilled cropland. Environmental benefits will include a reduction in nitrate and dissolved reactive phosphorus loadings from the treated areas to the River Raisin watershed and the Western Lake Erie Basin. This project builds on an earlier GLRI project which promoted voluntary best management practices designed to reduce nutrients from agricultural operations in the Raisin River watershed.
  • $265,980 to the Michigan Department of Agriculture and Rural Development to Reduce Sediment and Nutrients Entering the Western Lake Erie Basin: The Michigan Department of Agriculture and Rural Development will use this funding to increase implementation of effective conservation practices on farm fields to significantly reduce the quantity of sediment and nutrients discharged into the Western Lake Erie Basin. The project will prevent 30,400 tons of sediment, 42 tons of phosphorus and 67 tons of nitrogen from entering Lake Erie tributaries; 176 acres of wetlands will be restored.
  • $499,741 to the Grand Traverse Bay Watershed Initiative for the Kids Creek Stormwater Reduction Project: This project will improve water quality on a major tributary to Kids Creek, an impaired stream in the Grand Traverse Bay watershed, by replacing underground culverts and channelized ditches with a natural meandering channel. The new stream channel will eliminate 73,000 square feet of impervious area, establish 27,000 square feet of floodplain and create a 15- to 30-foot-wide buffer. Green infrastructure will also be installed to further reduce stormwater and sedimentation impacts to Kids Creek.
  • $995,204 to the Michigan Department of Environmental Quality for Kawkawlin River Targeted Phosphorus and E. Coli Reduction: This project will implement best management practices (BMPs) identified in the Kawkawlin River Watershed Management Plan. The BMPs include installing six miles of agricultural buffers, 1,700 acres of wind barriers, 1,000 feet of livestock exclusion fencing and planting 6,000 acres of cover crops. This project is expected to prevent E. coli, 15,491 pounds of phosphorus (30 % of the load reduction goal for the watershed) and 10,921 tons of sediment from reaching Saginaw Bay each year.
  • $798,282 to the Muskegon River Watershed Assembly for Restoration of Riparian Areas in the Muskegon River Watershed: This project will reforest more than 400 acres of riparian land, restore 150 acres of streambank using native vegetation, put 150 acres of revegetated or natural riparian land into conservation easements, develop 14 forest stewardship plans and implement proper erosion control best management practices at four riparian sites in high priority sub-watersheds of the Muskegon River. This project is expected to prevent 100 tons of sediment, 1,000 pounds of phosphorus and 6,000 pounds of nitrogen from reaching the Muskegon River, the Muskegon Lake Area of Concern and Lake Michigan each year.
  • $189,376 to Michigan State University for Locating and Targeting High-Impact Farm Fields to Reduce Phosphorus Discharges: This project will provide electronic mapping technology to agricultural conservation technicians (such as federal and state natural resource agency employees) that will help the technicians identify and target farm fields that are especially prone to high rates of phosphorus discharge. The technicians can then begin working with the owners of these targeted fields and encourage the implementation of conservation practices such as cover crops and improved management of phosphorus and drainage water. As a result of this project, conservation practice implementation can be focused on farm fields having the greatest impacts on water quality, ultimately resulting in a reduction of soluble phosphorus loading in the Saginaw basin.

US and Canada Amend Great Lakes Water Quality Agreement

U.S. Environmental Protection Agency and Canada’s Minister of the Environment have signed the newly amended Great Lakes Water Quality Agreement. The agreement, first signed in 1972 and last amended in 1987, is binational effort to protect the world’s largest surface freshwater system and the health of the surrounding communities.

The revised agreement will facilitate United States and Canadian action on threats to Great Lakes water quality and includes measures to anticipate and prevent ecological harm. New provisions address aquatic invasive species, habitat degradation and the effects of climate change, and support continued work on existing threats to human health and the environment in the Great Lakes Basin such as harmful algae, toxic chemicals, and discharges from vessels.

The overall purpose of the Agreement is “to restore and maintain the chemical, physical and biological integrity of the waters” of the Great Lakes and the portion of the St. Lawrence River that includes the Canada-United States border. Both governments sought extensive input from stakeholders before and throughout the negotiations to amend the Agreement. Additionally, the amended Agreement expands opportunities for public participation on Great Lakes issues.

Wisconsin and Michigan Awarded Great Lakes Restoration Initiative Grants

The U.S. Environmental Protection Agency has awarded seven Great Lakes Restoration Initiative grants, totaling over $2.6 million, to improve water quality at Great Lakes beaches in Michigan and Wisconsin. Projects awarded grant funding include:

  • $1 million (two grants of $500,000 each) to the University of Wisconsin Oshkosh to redesign eight Wisconsin beaches to reduce bacteria levels, resulting in fewer swimming bans and beach closures. The beaches are: Red Arrow Park Beach, Marinette; Crescent Beach, Algoma; Red Arrow Park Beach, Manitowoc; Thompson West End Park, Washburn; Grant Park, South Milwaukee; Samuel Myers Park, Racine; and Simmons Island and Eichelman Parks, Kenosha.
  • $179,700 to the City of Marquette, Michigan, to lower health risks and to improve water quality at two Lake Superior beaches in Marquette by using green management practices to reduce contamination.
  • $500,000 to the City of Marysville, Michigan, to install rain gardens and other green infrastructure to reduce contaminated stormwater runoff and to deter geese at Chrysler Beach on the St. Clair River.
  • $500,000 to the Huron-Clinton Metropolitan Authority for green infrastructure to reduce contaminated stormwater runoff at Lake St. Clair Metropark (Metro Beach.)
  • $217,015 to the Michigan Department of Environmental Quality to construct rain gardens, plant native grass and install a filtration system to improve water quality and reduce health risks at Sherman Park and Four Mile beaches in Sault Ste. Marie.
  • $263,188 to the Michigan Department of Environmental Quality to build a green stormwater infiltration system at New Buffalo City Beach to reduce bacteria and nutrient levels.

Water Quality Based Effluent Limitations for Phosphorus Approved

US EPA has approved the program in Wisconsin to control the discharge of phosphorus to surface waters. Wisconsin adopted the new subchapter, Wisconsin Administrative Code Chapter NR 217, Subtitle III, “Water Quality Based Effluent Limitations for Phosphorus,” in 2010, but EPA did not approve it until July 25, 2012.

Wisconsin's program will allow permit holders (such as publicly owned treatment works, or POTW) to meet phosphorus discharge requirements through partnership arrangements with others who release phosphorus. Permit holders can make such arrangements to achieve phosphorus reductions more economically. This will allow communities and other permit holders to save money while still ensuring overall phosphorus levels are reduced in the watershed.

Advisory Board For Great Lakes Restoration Initiative

The U.S. Environmental Protection Agency has announced the creation of an advisory board to support federal agencies with the implementation of the Great Lakes Restoration Initiative and the updated Great Lakes Water Quality Agreement. The new board will provide advice and recommendations to EPA Administrator as federal Interagency Task Force chair.

To form the board, EPA will consider candidates from a broad range of interests including environmental groups, businesses, agricultural groups, funders/foundations, environmental justice groups, youth groups, academia and state, local and tribal representatives as needed. Nominees will be solicited through a Federal Register notice. EPA anticipates that board will be established during summer 2012.

The Interagency Task Force is made up of 16 federal agencies and departments. In 2010 they developed an action plan to implement initiatives in five areas:
  1. Cleaning up toxics and toxic hot spot Areas of Concern.
  2. Combating invasive species.
  3. Promoting near-shore health by protecting watersheds from polluted runoff.
  4. Restoring wetlands and other habitats.
  5. Raising public awareness, tracking progress, and working with partners.
The plan also establishes annual benchmarks for success and progress.

EPA & USCG Coordination to Enforce Vessel General Permit Program.

U.S. Environmental Protection Agency (EPA) and U.S. Coast Guard (USCG) today signed a memorandum of understanding (MOU) to work together to enforce EPA’s vessel general permit program. The MOU outlines steps the agencies will take to better coordinate efforts to prevent and enforce against illegal discharges of pollutants from vessels, such as cruise ships and oil tankers.

Under the MOU, USCG has agreed to incorporate components of EPA’s vessel general permit program into its existing inspection protocols and procedures to help the United States address vessel pollution in U.S. waters. The MOU creates a framework for improving EPA and USCG cooperation on data tracking, training, monitoring, enforcement and industry outreach. The agencies have also agreed to improve existing data requirements so that information on potential violations observed during inspections can be sent to EPA for evaluation and follow-up.

The vessel permit program applies to more than 61,000 commercial ships based in the U.S. and more than 8,000 foreign ships operating in U.S. waters. The vessel permit covers 26 types of discharges such as deck run-off from rain, ballast water used to stabilize ships, and wastewater from showers, sinks and laundry machines. These discharges may result in negative impacts on the environment, including the spread of invasive species from ballast water that can harm sensitive ecosystems. The vessel permit program also specifies corrective actions, self inspections and self monitoring, record keeping and reporting requirements.

Comments On Vessel General Permit Requested

U.S. Environmental Protection Agency (EPA) has scheduled a session to request input on suggested improvements for the next Vessel General Permit (VGP). The VGP is a General National Pollutant Discharge Elimination System (NPDES) permit that regulates discharges incidental to the normal operation of certain vessels. EPA is seeking public comment on requirements currently contained in the 2008 VGP, which expires in 2013, and any changes or additions recommended for the next permit.

The listening session will be held on December 15, 2010 at EPA Headquarters, Washington, D.C. EPA will accept written comments and relevant information for developing the next permit until December 31, 2010.

New Antidegradation Requirements In Proposed Wisconsin Stormwater Permits

The Wisconsin Department of Natural Resources (WDNR) has published four of its proposed reissued general permits for storm water discharges. To review a summary of each of the permit, click on the links below:

Tier 1 Industrial Facilities (Permit No. S067849-3);
Tier 2 Industrial Facilities (Permit No. S067857-3);
Recycling of Scrap and Waste Materials (Permit No. S058831-2); and
Dismantling of Vehicles for Parts Selling and Salvage (Permit No. S059145-2).


Some of the key changes reflected in WDNR’s proposed permits compared to the expired permits involve additional requirements placed on facilities that discharge to certain types of water bodies, especially in reference to Wisconsin's antidegradation policy. Some of the key changes are:

Discharges To Outstanding and Exceptional Resource Waters. A facility covered under the permit may not create a new storm water discharge to an Outstanding Resource Water (ORW) or an Exceptional Resource Water (ERW) unless the facility’s storm water pollution prevention plan (SWPPP) is updated to prevent the discharge of pollutants above background levels within the water body.
What are Wisconsin Outstanding Resource Water (ORW) or an Exceptional Resource Water (ERW)?

WDNR defines “new storm water discharge” as a discharge that did not exist before the start date of permit coverage. A new discharge does not include an increase in a storm water discharge to a water body to which the facility discharged on or before permit coverage started.
If a facility has an existing storm water discharge to an ERW, it may not increase the discharge of pollutants that results in a violation of water quality standards. If a facility has an existing storm water discharge to an ORW, it may increase the discharge of pollutants provided that: 1) the pollutant concentration within the receiving water would not increase; and 2) the increased discharge would not result in a violation of any water quality standard.

Discharges To Impaired Water Bodies and Total Maximum Daily Load Requirements: If a facility discharges a pollutant of concern to a listed impaired water body, the pollutant levels in the discharge need to be reduced as much as possible as part of an overall state effort to reduce the pollutant loading to impaired water bodies. The proposed permit requires that an annual check be conducted to determine if the facility discharges listed impaired water body, and to update their SWPPP to reduce the pollutant of concern

Federal law prohibits the issuance of a WPDES permit to a new source or new discharger that will contribute to a violation of a water quality standard in a listed impaired water. For a new facility requesting coverage under the general permit, the DNR will evaluate the proposed new pollutant discharge and receiving water to determine if the above requirement can be met.
The proposed permit also requires that facilities conduct an annual check to determine whether the facility discharges storm water runoff to a water body that has an EPA approved TMDL allocation, and to determine if additional storm water control measures are necessary.

Discharges To Fish and Aquatic Life Waters: Under the general permit, a facility must determine whether its discharges storm water to a fish and aquatic life water as defined in Wisconsin Rules. Most receiving waters in Wisconsin are classified as a fish and aquatic life waters. A facility can not create a new storm water discharge to a fish and aquatic life water unless the storm water pollution prevention plan is designed to prevent the significant lowering of water quality.
What are Wisconsin Fish and Aquatic Life Waters?

Compliance with Runoff Management Performance Standards: Wisconsin Rules specifies post-construction performance standards for new development and redevelopment. A newly constructed or redeveloped industrial facility that is required to meet the post-construction performance standards must describe in its SWPPP the BMPs necessary to maintain compliance with the applicable performance standards.

Discharges To The Great Lakes & Tributaries: Under the proposed permit, discharge of persistent, bioaccumulating toxic (PBT) substances to the Great Lakes waters or their tributaries, must be limited to the maximum extent practicable.

New York Great Lakes Restoration Grants

U.S. Environmental Protection Agency has announced grants totaling $20 million in New York State under the Great Lakes Restoration initiative. The grant recipients include tribes, state and local agencies, non-profit organizations, and colleges and universities. Among the project funded in New York are:

Be Green in the Great Lakes. This project will encourage homeowners and land care providers to adopt organic land care practices that reduce water use and avoid the use of synthetic pesticides and fertilizers. New York State Department of Environmental Conservation (NYSDEC) will initiate an education and outreach program that will disseminate brochures and web content, hold training sessions, and introduce NYSDEC's "Be Green Organic Yards NY" program. Grant recipient is the NYSDEC. Grant amount is $315,223.

Buffalo River Area of Concern Habitat Restoration – Riverbend. This project will result in the design, implementation, and monitoring of a restoration project at the Riverbend site on the Buffalo River. This is a former industrial site and these efforts will help restore the area's natural habitat. The work will include 2,800 feet of river bank enhancement, plus 6.3 acres of floodplain habitat restoration. Tasks include river bank regrading to reduce soil erosion, planting native trees and shrubs, and removal of invasive plant species. Two years of vegetation surveys and monitoring will then occur. Grant recipient is the Buffalo Niagara Riverkeeper. Grant amount is $657,245.

St. Lawrence River Area of Concern and St. Lawrence River Sturgeon Restoration. The first project will focus on four beneficial use impairments (restrictions on fish and wildlife consumption, degradation of fish and wildlife populations, bird/animal deformities or reproductive problems, and loss of fish and wildlife habitat) in the St. Lawrence River, near Massena, NY. The project will monitor furbearers, turtles and birds, and conduct tissue analysis of wildlife to assist decision-makers considering restrictions on wildlife consumption. Grant amount is $1,229,415. The second project will advance efforts to restore Lake Sturgeon in the St. Lawrence River by investigating suitable spawning habitat, water quality, and causes of reproductive failure. Project amount is $723,107. Grant recipient is the St. Regis Mohawk Tribe.

Michigan Great Lakes Restoration Initiative Grants

U.S. Environmental Protection will provide more than $2 million in grants to three southeast Michigan organizations under the Great Lakes Restoration Initiative. A total of 99 grants for an estimated $63 million are expected to be awarded in Michigan. Funded projects advance the goals and objectives of the Great Lakes Restoration Initiative Action Plan which released in February.

Southeast Michigan Council of Governments was awarded $500,000 for its "Restoring the Lake Erie Corridor Through Green Streets" program. The funds will pay for construction of bioswales, tree trenches and grow zones to manage road runoff; reduction of annual stormwater runoff volumes, sediment and nutrient loading by approximately 50 percent; development of a Great Lakes Green Streets Guidebook transferable to municipalities; and installation of Green Streets signage for public education benefits.

Michigan Department of Natural Resources and Environment will receive $1,028,548 for "Rapid Response to Invasive Species." This project will use the best known methods to eradicate and control several invasive aquatic plant species that harm the Great Lakes. The program will help direct future resources for invasive species control to the most cost-effective, strategic and highest threat locations.

Wayne State University was awarded $519,564 for "Verification of Ballast Water Treatment Technology." This project is designed to develop technology that will help assess the effectiveness and durability of shipboard ballast water treatment systems.

Great Lakes Compact - Proposed WDNR Water Use Rules

The Wisconsin Department of Natural Resources (WDNR) has proposed rules regarding Water Use Fees, Water Use Registration and Reporting, and Water Use Conservation and Efficiency. These rules are proposed as part of the State’s response to the Great Lakes Compact.

The first rule proposes water fees in a new chapter NR 850, and could affect surface water supply systems with the capacity to withdraw 100,000 gallons per day (“GPD”) or more.

The second rule contains new registration and reporting requirements. Proposed chapter NR 856 would require any system with the capacity to withdraw more than 100,000 GPD to register the withdrawal within six months of the rules effective date. If registration is required, then the facility would also be required to determine the monthly volume of water withdrawn, and will be required to file annual reports with DNR.

The third proposed rule addresses water conservation and use efficiency measures. Draft chapter NR 852 includes different conservation requirements applicable to three tiers of new or increased withdrawals. Tiers 1 and 2 apply to new and increased withdrawals from the Great Lakes Basin. Tier 3 includes new or increased diversions to a straddling community or county, new and increased intrabasin transfers, or new and increased withdrawals averaging more than 2,000,000 GPD.

The draft rules will be available for public comment until July 7, 2010. WDNR also expects to have additional related rules available for public comment in Fall 2010.

Great Lakes Restoration Initiative Action Plan

U.S. Environmental Protection Agency (EPA) , in collaboration with 15 other federal agencies, have made restoring the Great Lakes a national priority and is proposing a budget of $475 million for a Great Lakes Restoration Initiative (Initiative). The EPA Action Plan, recently released, describes how the Initiative will be executed from 2010 through 2014.

The Plan builds on the Great Lakes Regional Collaboration Strategy (GLRC Strategy). The GLRC Strategy provides a framework for the Action Plan. The Action Plan has five major focus areas:
  • Toxic Substances and Areas of Concern, including pollution prevention and cleanup of the most polluted areas in the Great Lakes
  • Invasive Species, including efforts to institute a “zero tolerance policy” toward new invasions, including the establishment of self-sustaining populations of invasive species, such as Asian Carp
  • Nearshore Health and Nonpoint Source Pollution, including a targeted geographic focus on high priority watersheds and reducing polluted runoff from urban, suburban and, agricultural sources
  • Habitat and Wildlife Protection and Restoration, including bringing wetlands and other habitat back to life, and the first-ever comprehensive assessment of the entire 530,000 acres of Great Lakes coastal wetlands for the purpose of strategically targeting restoration and protection efforts in a science-based manner
  • Accountability, Education, Monitoring, Evaluation, Communication and Partnerships, including the implementation of goal- and results-based accountability measures, learning initiatives, outreach and strategic partnerships

The Action Plan identifies goals, objectives, measurable ecological targets, and specific actions for each of the five focus areas identified above. The Action Plan will be used by federal agencies in the development of the federal budget for Great Lakes restoration in fiscal years 2011 and beyond. As such, it will serve as guidance for collaborative restoration work with participants to advance restoration. EPA believes that the Plan will also help advance the Great Lakes Water Quality Agreement with Canada.

Court Approves MPCA Vessel Discharge Permit Rules

The Minnesota Court of Appeals ruled in favor of the Minnesota Pollution Control Agency’s (PCA) new regulations to control ballast water discharges from ships on Lake Superior.

The Minnesota Center for Environmental Advocacy had filed suit against the PCA saying the agency was moving too slowly and had standards too lax to regulate ballast water. The group wanted tougher standards on ships imposed sooner than 2012 for new ships and 2016 for existing ships the PCA has called for.

The court’s decision upholds the rules promulgated by the PCA last year for nearly all ships that discharge any ballast water or carry ballast water through Minnesota waters of Lake Superior.

Great Lakes Initiative GLI Human Health Based Criteria

What is a Human Health-based Water Quality Criterion?

The Water Quality Guidance for the Great Lakes System, also known as the Great Lake Initiative or GLI (40 CFR 132), created a few new types of water quality standards intended to be applied to waters in the Great Lakes basin.

A Great Lakes Water Quality Human Health-based Criterion (HHC) is intended to protect humans from unacceptable exposure to toxicants via consumption of contaminated fish and drinking water and from ingesting water as a result of participation in water-oriented recreational activities. The criteria were developed to provide a level of protection likely to be "without appreciable risk" of carcinogenic and/or noncarcinogenic effects.

Chemical concentration levels protective of human health are derived based on either a Tier I (“Tier I Criterion”) or Tier II (“Tier II Value”) classification. The two Tiers are primarily distinguished by the amount of toxicity data available for deriving the concentration levels and the quantity and quality of data on bioaccumulation.

For known or suspected carcinogenic chemicals, the criterion are derived at a level corresponding to an incremental cancer risk of 1 in 100,000. Noncarcinogens are generally assumed to have a threshold dose or concentration below which no adverse effects should be observed. The Tier I criterion or Tier II value is the maximum water concentration of a substance at or below which a lifetime exposure from drinking the water, consuming fish caught in the water, and ingesting water as a result of participating in water-related recreation activities is likely to be without appreciable adverse effects.

Human-health based water quality criteria were derived for 17 compounds (see below); however, the GLI detailed the methodology to derive human health-based criteria for other compounds.

Use of Aquatic Life Standards As Stormwater Benchmark Values

On July 6, 2009, the Minnesota Pollution Control Agency (MPCA) released the draft of its proposed multi-sector industrial stormwater discharge general permit. This permit, once promulgated, will replace the existing industrial stormwater permit, which expired in October of 2002.

The MPCA draft permit is of interest outside of Minnesota because of the numerous unique requirements that MPCA has included. Many of these go well beyond other current State general permits, and even the most recent US EPA general permit (“MSGP-2008”). Unique features of the MPCA permit include special stormwater antidegradation requirements, design and performance requirements for stormwater infiltration, requirements for mercury minimization, and others.

One unique feature of the draft MPCA general permit is the use of Aquatic Life Standards as Stormwater Benchmarks. Stormwater benchmarks are used to evaluate the effectiveness of stormwater Best Management Practices (BMP). MPCA is currently proposing to use some Final Acute Values (FAV) and “Great Lakes” derived water quality standards as stormwater benchmarks. For other proposed benchmarks, “Best Professional Judgment” is the basis for the values.

MPCA is proposing to use FAV that apply to cold water fisheries or “trout streams” (Class 2A) for a number of benchmark chemicals, including:

Selenium
Silver
Zinc

For some of these chemicals, MPCA is apparently considering water quality-based adjustments, based on parameters such as hardness, pH, temperature, etc.

These water quality-based benchmarks, as proposed, would not apply to all industrial categories. The industry sectors that would be subject to one or more water quality derived benchmarks include:

MPCA Water Quality Standards - Revised Rule 7050 - 7052

The Minnesota Pollution Control Agency (MPCA) is requesting comments on its planned amendments (“Triennial Review”) to rules governing state water quality standards found in Minnesota Rules Chapters. 7050 and 7052.

- Chapter 7050 includes provisions to protect Minnesota’s waters from pollution.
- Chapter 7052 provides standards specific to surface waters of the state in the Lake Superior Basin.


The Federal Clean Water Act (CWA) requires States to review their water quality standards every three years (“Triennial Review”) and to amend and update them if necessary. The MPCA initiated this triennial review by seeking comments in a Request for Comments published in the July 28, 2008, State Register. The key amendments being considered for the upcoming Triennial Review include:

  • Planned Amendments for Numeric Standards for Class 2 waters
  • Eutrophication standards for river systems.
  • Revised turbidity standards
  • New or revised contaminant standards for protection of aquatic life and human health from toxic effects related to:
    1. Cadmium
    2. Copper
    3. Chloride
    4. Diazinon
    5. Nonylphenol
    6. Nitrate

  • Updates in methods to human health-based chronic water quality standards
  • Amendments to Class 3 (Industrial Consumption) and Class 4 (Agriculture and Wildlife) standards.
  • Potential Water Use Classification Changes for Specific Water Bodies
